As personal data privacy, yours as well as that of your candidates, is of the utmost importance to us, our platform was designed to simplify and ease compliance to GDPR regulations. To that end, we’ve included features that help Manatal users meet the specific requirements set by the GDPR.

Our goal is to provide you with the tools necessary to adhere to data privacy laws and regulations, and remain informed of the various rights accorded to yourself and your candidates as you recruit.

Data Security & Transfer

‍

Manatal ensures the highest level of security for its clients by:

• Encrypting all of our clients’ candidate databases.
• Running daily back-ups of our database to ensure your information bank is safe and retrievable.

In addition, our servers are located in the US and we are currently hosted on AWS (Amazon Web Services), one of the most secure and comprehensive cloud-service providers in the world.

As of July 10, 2023, the European Commission has approved the adequacy decision concerning the EU-US Data Privacy Framework. This decision enables the seamless transfer of personal data from the EU to entities like AWS located in the United States, provided they are part of the Data Privacy Framework. Consequently, the transfer of data from the EU to the US is now in compliance with legal regulations without the need for a Data Processing Addendum.

Data Subject Consent

According to our understanding of Article 6 of the GDPR (quoted below), collecting resumes and other relevant information from candidates is considered a “legitimate interest” for a company trying to evaluate and hire/place candidates, and therefore companies should not be obliged to collect consent from job applicants.

1. "Processing shall be lawful only if and to the extent that at least one of the following applies:

• the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
• processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
• processing is necessary for compliance with a legal obligation to which the controller is subject;
• processing is necessary in order to protect the vital interests of the data subject or of another natural person;
• processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
• processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child."

Data Subject Rights

Under GDPR regulations, data subjects are protected by the following:

• Rights to Notice and Access
• Right to Object

To help you remain compliant on those three requirements, Manatal includes a number of features:

• Easily automate data processing consent gathering from candidates via email.
• Delete candidates directly from their profile when your legal justification for keeping the data has expired or when a candidate asks to be forgotten.
• Share relevant information on your career page to make sure necessary disclosures and disclaimers are displayed to candidates when they apply.
• Respond to data requests from candidates by extracting their data and sharing it through a CSV file.
• Candidates have the capacity to unsubscribe from any marketing emails and can be tagged as such directly from their profile page.
